You need to check if any items are actually available in the CCK field, otherwise you run into issues when trying to display them. As its valid having not items ( so no display ), you need to just apply the patch.

Thanks for reporting EugenMayer, I believe this was actually fixed recently, see #826896: PHP warning when no images exists and the commits from June 14, 2010 http://drupal.org/project/cvs/794682

So this should be fixed in the dev version. Although your way of doing it might be a bit cleaner to maintain, true. Feel free to reopen if this is stil the case in the latest dev.
