I have a role that can edit and create all content sitewide but this role cant create new spaces. This role should however be able to create new sections in spaces (which it can if i access the path directly) but the "Create new section" menu element is gone. This should be available when the user has permissions to create sections in space.

Be sure you are setting the Organic Groups permissions and not the global Drupal permissions. The OG permissions take priority.
