update.php used to set MAINTENANCE_MODE == 'update', then it was moved to a controller which doesn't.
authorize.php still does set that constant value, but that's not really tested or used much at all.
Some functions were never updated to reflect this, for example:
https://api.drupal.org/api/drupal/core!modules!user!user.module/function...
Remove references to MAINTENANCE_MODE == 'update' and code that relies on it.

wuinfo - bill wu commentedI am a little bit concerned about changing maintenance mode into True when executing update batch.
1) Production sites will be affected. Every time executing batch we update the DB, system will get into maintenance mode.
2) What if the database update is from contributed modules. If an update ran into a problem and stopped in the middle, the maintenance mode will not get a chance to change back to its original status.
3) Drupal core manages and controls maintenance mode. I feel it is a door that open to contributed modules. They may accidently change a system maintenance mode.
Here is the list files that are using constant MAINTENANCE_MODE

alexpott+1 The whole concept of a MAINTENANCE_MODE constant is problematic for testing and consistent behaviours. See #3279850: Theme post updates are not recognised when the theme is used in the installer for an example.
