Switching of 'create webform,' in 'user permissions / module nodes' for a role does nothing. For that role there is stil a menu link 'add webform' (node/add/webform) and that webform can be made by that role.

That role kan also edit a webform in 'admin/content/webform'

There is no "create webform" permission in Webform 3.3 (though there was in Webform 2.x). I'm not sure what you're referring to. There is a permission for "create webform content", but it's owned by Node module, not Webform. It may be that the user role you're referring to also has "administer nodes" permission, which will allow all types of content to be created, regardless of other permissions.

I am seeing the same thing. I had Webforms 2.x until recently. When I upgraded to Webforms 3.x, I am seeing Webform as a content type. There are permissions for it, just like with any other content type, but the settings do not take effect.
Previously only I could create webforms, now even anon users can!
As I understand Webforms 3.x, a webform can now be attached to any content type, making the "Webform" type obsolete, but I have webforms that were created under the old system.

If a Webform is a content type now, it should follow the usual content type permissions.

So not an issue then? I can assure you Webform has absolutely no special permissions built-into it that have any control over the node/add/x or node/x/edit pages. The problem you're experiencing you'd have regardless of whether it was a Webform content type or not.

The issue is that the menu items still appear for all users, even anon, no matter what the permissions. No one but admin can create or edit the webform content type, yet they show up.
I had to move the menu items for myself so they would not be in the "create content' menu.

Still no idea how to reproduce this issue. If you can provide steps on how to reproduce this issue from a clean install of Drupal I'll have a look, but as I've stated a few times, I don't think Webform is responsible for this problem.
