You can still checkout even without clicking "I agree with the Terms of Service" checkbox. Doesn't seem to be checking properly. Only tested on checkout, not cart.

Yep, the required flag for the cart pane won't work in short term as each form in the cart pane is independient from the others and the validation is not issued.

I've rolled up a patch for fixing the required in checkout pane.
