When no tabs are rendered, a blank gray box is drawn. This was fixed in the D6 version, but not fixed in the D7 version. Patch will be attached.

I applied your patch but unfortunately it didn't work. The empty tab is still visible.

Sounds like you have misunderstood what this patch was for. As the original issue says:

When no tabs are rendered, a blank gray box is drawn.
