Error on minify jquery.js

Minifying jquery.js produces error:

Notice: Undefined index: scope in drupal_get_js() (line 4421 of /home/user/www/includes/common.inc).

Using the Drupal version of jquery (not using jquery_update)

Not sure if this needs to be "fixed" or simply ignored by minify as the fix?
