the LICENSE.txt file is not necessary in the indivudal theme file because it is included at the base of the CVS repositories. Please remove this file from your theme's directory.

This is not anymore true since Drupal.org moved to Git.

Drupal Git Contributor Agreement & Repository Usage Policy does not forbid to add a license file in a project repository; it just says that projects hosted on drupal.org are licensed under the same license used by Drupal core. As long as the license is correct, the file can stay.

(There is not any license file, in the repository.)
