My designer has done a mix of framework with marinelli theme plus a bit of css changes, www.forniture-alberghiere.net
and I need to know:
1) can I upgrade framework or I risk to loose my actual theme?
2) if is better that I don't upgrade my customized theme, how I can stop to receive alerts to upgrade it?

andregriffin commentedFramework, or any other customized theme, cannot be automatically upgraded. The modifications made to the theme would have to be re-applied to the new version. Most of the time this is unnecessary, unless there is a useful fix or feature that would make it worth it to you to do this manual upgrade.
As far as stopping the notification of updates, the framework.info file would need to be altered to no longer associate the theme with Framework. Do do this, temporarily change to a default theme like garland, then modify the framework.info file found in the framework directory (you may want to make a backup of this file just in case and put it somewhere outside of your themes directory). You can change the name of the theme, delete the entire " ;$Id: ..." line at the top, change the description, and remove the "; Information added by drupal.org packaging script on..." as well as everything after that line. This should disassociate your theme from the Framework project. Once the changes are made and the new framework.info file is on the server, you can re-enable the theme.
