I think Karen added the fieldsets in the BAF patch as a way to separate (full text, summary) pairs for different 'text_with_summary' fields that may live in the same form.

I'd rather see site administrators deal with that using fieldgroup module or similar. It doesn't look right out of the box - which is a much more common case than having two fields like that on one bundle.
