$settings = $display['settings'];

should should be changed to

$settings = isset($display['settings']) ? $display['settings'] : array();

$settings = $display['settings'] is used in dozens of places, not just by Date but by lots of other modules, including Node Reference and User Reference. If some other module is doing something that is not providing that value, Date is not the only thing that is going to break.

I don't think this is a Date problem and this is not really actionable as posted.
