Believe it or not this is a simplemenu problem. if theme() is called any where in a hook_init(), then things get all screwy. See: http://drupal.org/node/219910.
So the chain of function calls to get to theme() is like so:
- simplemenu_init()
- simplemenu_get_menu()
- simplemenu_menu_tree()
- menu_tree_output()
- theme(...)
This patch moves the guilty code into hook_footer() which means it has to be directly output to the footer; no more drupal_add_js goodness.
