The Fresh Media theme (link to original) is offered on it's author's website under a Creative Commons Attribution 2.5 License.
It has been ported to Drupal by the owner of the Drupal 6 theme Fresh Media and is automatically re-licensed and distributed from our repo under GPLv2+. This is legal for us to do: Reason: Since CC BY 2.5 is not a copyleft license, and the code had to be transformed somewhat for it to to become a Drupal theme, it is legal for the derivative work (the PHP code) to be re-licensed under GPLv2+ as per our Git Repo policy. The non-code components are not transformed and must remain under the original CC BY 2.5 license, which is whitelisted as "GPL friendly".
However, the current Fresh Media repo does not fulfil the attribution requirement that is both required by its original license and by our policy described in: Policy on 3rd party assets on Drupal.org:
Any third party assets you include must have their provenance, license and source documented in a file included in the project.
Two weeks have now gone by and the documentation/attribution requirement has not been resolved.
The next step is to mark the project has abandoned.
