Non GPL files included in this theme [#1293940]

Modernizr 2.0.4 (Custom Build) | MIT & BSD

Sorry, not allowed in Drupal VCS. Please remove this file and update your project page - if people want this they will need to download the Modernizr lib from an external site. As it stands at this time Modernizr is not GPL and therefor expressly prohibited from being included in any project.

I thought the MIT license was acceptable.

I really, really, really wish they were, I too would like Modernizr in my themes as well, and a whole bunch of other stuff also :)

I put an issue into webmaster issue queue about this because I found other projects using Modernizr, so see http://drupal.org/node/1295890, could be OK after all, if so, dude, I am so apologetic, I have always been roasted when I tried to include libs and scripts that were not GPL.
