Aggregation of JavaScript files (under development/performance) fails i.e. all JS fails to function if jQuery Update is set to use jQuery version later than 1.8 (e.g. 1.9 or 1.10).

IMPORTANT - I am not sure if this is related:

I have the Public file system path set to other than the default setting i.e.: sites/default/files

and I am running Nginx

I also found this. But I'am turn off aggregate, clear cache, and turn on again it works fine. I had problem the popup date selectors.
