Setting up a new site with Drupal is complicated by the fact that file upload configuration is included in the global settings. Until a file directory has been manually created such that the user can enter a directory on the settings screen, no other configuration is possible because the files and tmp fields are required and the form blocks saves.
It is conceivable that a site may have no need for uploading files. It is even more conceivable that file uploads will not be the first priority when installing a new site. For this reason, and quite possibly others as well, file configuration should be moved elsewhere.

theoa commentedSomebody seems to have been working on this issue - in a really good way.
I've just created a fresh install from cvs - using the multiple site feature.
I deleted the files directory.Then went to the Administer - Settings - File System Settings. The "files" directory was listed in "File system path:" I clicked Save Configuration. Using a shell, I noticed that Drupal had created the Files directory.
I tried this several times and created directories within subdirectories without any issue.
Suggestions:
1. Could somebody confirm that work has been done in this area?
2. It looks like documentation would need updating
