If you look at mimemail.inc:422, you'll see the path to the file can be uri or filepath. In my case (Using rules "Send html email" with mimemail) the attachment was using 'filepath'.

I've modified the patch from the previously committed issue that added mimemail support.

Patch still needed when sending attachments using Rules + Mimemail. Mimemail sometimes uses 'filepath' instead of 'uri'. Attached patch works for me with latest dev

i'm getting filepath instead of uri too, I think it caused by file tokens in attachment section,
patch #4 works for me
