I've read through your ToS and - although generally legalese makes my head hurt - I am interpreting it as if you would use your service to put advertising on your users' sites.

Yet, the project page doesn't mention that at all.

I think this needs fixing.

First of all thank you for your report.

There are four variants of using KeyCAPTCHA now:

1. Website owners earn money by using KeyCAPTCHA. In this case we pay them for ads
in KeyCAPTCHA on their websites.
2. Website owners pay us for personal CAPTCHAs. In this case website owners can use their own
images to create their own CAPTCHAs (with their or third party
advertisement or without any ads) which will be displayed on their
websites.
3. Combination of 1 and 2.
4. Standard KeyCAPTCHA. In this case website owners don't earn money and website owners don't
pay us. If website owners choose this way we will display our standard CAPTCHAs
(without any ads) on their websites.

In any case we will try to change the content of our project page this or next week.

Best regards,
KeyCAPTCHA Team

Priority:Normal» Major

The project page says "free" several times but doesn't mention "ads" at all. This is quite misleading and needs to be fixed.

The standard for accuracy on module pages is much higher than other parts of drupal.org (especially for issues related to a third party service).

Please make it a high priority to fix the description.

"If website owners choose" while the old users are already being sent keycaptchas with ads puzzle pictures + ads links in them w/o any previous notice or agreeing with webmasters.

Your https://www.keycaptcha.com/whatisit/?s=forwm-variants does not leave any free options without ads
In other words, choosing non-ads option automatically entitles to buying fee-based "Personal CAPTCHA", and if it was not paid, agreeing to pass "meanwhile" 3d-party ads.

So, what's the point in documentation correction if KeyCAPTCHA's ToS permits to interpret whatever it likes, change when it is convenient and impose its own ever-changing conditions?

Funny but such promotion of plugins to the external 3d party commercial services without completely free working unrestricted for use (by, for ex.,enforced advertising) versions is not permitted even on commercial CMSs web siteslike vBulletin.org:
http://www.vbulletin.org/forum/info.php?do=rules#paid

Restoring appropriate tags (none, in this case).

sorry, thanks for correcting me!

Thanks for editing the project page to add these four mechanisms.

I suggest you remove the word free from the first and 3rd sentence on the project page. Something that is sometimes free and sometimes paid should not be advertised so strongly as being "free."

KeyCAPTCHA Scammed’s picture

I couldn't agree more because practically all commercial services/products have free versions.
AFAIU, KeyCAPTCHA service is ADWARE, or advertising-supported software (here is a link to wiki-definition) but not FREEware or free service software/plugin

And especially b/c the KeyCAPTCHA's defaults and previous installs are serving advertising.
Shouldn't that, at least, for old (previous) users that started to use KeyCAPTCHA due to its initial promotions as free then afterwards converted into adveritsing-supported, be changed?

I hope the description of KeyCAPTCHA project here will not contradict keycaptcha.com website's descr
https://www.keycaptcha.com/whatisit/?s=forwm-variants&changelang=en
and real current practice still in use now

Hello Greg,

For your information: We have added "Free" word to the 4th variant. The reason is that this variant is free.

KeyCAPTCHA Scammed’s picture

https://www.keycaptcha.com/whatisit/?s=forwm-variants tells:

"This option perfectly fits publishers who are willing to use our service without ad displaying and are not willing to pay. For example, this option fits for websites of non-profit organisations. In this case our standard CAPTCHAs will be displayed on your website. Our standard CAPTCHAs don't contain ads"

It tells that STANDARD KeyCAPTCHA will be displayed "in this case", which is "for non-profit organisations"
If it is so, then it is not "Free KeyCAPTCHA", as it is written both here and there:
* https://www.keycaptcha.com/whatisit/?s=forwm-variants
* http://drupal.org/project/keycaptcha

It is "free for non-profits KeyCAPTCHA"

Just to remind, having a "free" version, bonuses, charities, gifts, etc. cases doesn't entitle a whole service (product) to be called free

Update:
Most commercial IT products/services have free editions/versions. And the non-free versions/editions have free evaluation periods and even evaluation editions unrestricted in functionality, during up to 6 first months, free use, for non profits, dev and academic use free licensing schemes what do not make from them free!

And they are not promoted as freeware producrs/services to get users willing to use them as freeware and thereafter to change licensing to commercial schemes of exploiting the trust of users.

In case of KeyCAPTCHA, the licensing and ToS still sound intentionally equivocal and abusing the trust of users.
Note that restoring back its so-called free option was made without any changes in ToS and notices of its users, etc. while ToS explicitly disclaim and waive any restrictions of responsibilities, guaranties and "may revise this Agreement periodically" (10.2 of KeyCAPTCHA's ToS) and even any notices of such changes ("The User shall visit the Site to make sure that he or she is familiar with and accepts all revisions", same 10.2 of the same ToS).

Meanwhile this all (and much more) explicitly multiply contradict to many national and international laws on providing online services, information, and advertising which stipulate responsibilities of not only provider or distributor of information and advertising but also their intermediaries (in this case, users of KeyCAPTCHA service)

The description of KeyCAPTCHA project in Drupal.org and in keycaptcha.com website tells:

"We pay for your protection"

which is incorrect.
This was also published on vBulleting.org as long ago as on August 5, 2011

Answering the question of a client why his revenue was zero after a month of "being paid" or participating in advertising, KeyCAPTCHA stated that KeyCAPTCHA.com pays only for passing advertising captchas, but not for protection as such, and they were absent due to the absence of advertisers

Today, KeyCAPTCHA Team massively sent Email letters stating that:

"Ad displaying in KeyCAPTCHA at your website(s) will launch on September 12, 2011"

while "We pay for your protection" was published on keyacptcha.com web site since August 2, 2011.

It should be noted that all those changes :
* from complete removal of completely free option (with threatening by a ban of users who would hack KeyCAPTCHA to remove ads, August 5, 2011)
to
* its declaration of restoring ((without officially informing users about this during 3 weeks)
are happening without any changes in ToS during, at least, the last 5 weeks!!!

The terms "we", "pay", "for", "your" and "protection", used by KeyCAPTCHA Team, do not reflect commonly accepted and understood definitions for them, are misleading and should be clearly defined in context of KeyCAPTCHA project.

Dear Visitors,

The person spreading a slander and a lie regarding the KeyCAPTCHA Service uses different nicknames on different web resources.
He thinks up his new slander and lie from time to time.

You can find it out by googling "KeyCAPTCHA is under attack" (quoted).

This person extorted money from our employee. And he had been caught by the police when he was taking the money.
This person alleges that he had been our employee. But it is the lie.
We are not going to conceal that he assisted us in supporting our twitter account.
But after the numerous reprimands regarding the quality of his messages on our twitter, we had fulfilled all our obligations to this person and renounced his assistance.
But he has never been an employee of our company.
We just had a verbal agreement with this person.

Here are a couple of facts regarding his slander:
The Twitter support team had blocked his 3 accounts of his slander and lie on the KeyCAPTCHA Service right after our request and his 2 accounts without our requests.
Scam.com support team has blocked his 2 accounts of the same lie.

We would appreciate if you send us URLs of pages with his slander and without this reply.
To do it please, use http://hidemail.at/xihp2h

We are not going to reply to his future messages on this website. It is not our goal.
We just wanted to publish the facts regarding this person.

Please be careful when reading information from this person.

Our service and company are absolutely legal.

Here are the variants of using KeyCAPTCHA:

1. You earn money by using KeyCAPTCHA. In this case, we pay you for ads in KeyCAPTCHA on your website.
2. You pay us for personal CAPTCHAs. In this case, you can use your own images to create your own CAPTCHAs (containing your or third-party advertisement or without any ads) which will be displayed on your websites.
3. Combination of 1 and 2.
4. Free KeyCAPTCHA. In this case, you don't earn money, and you don't pay us. If you choose this way, we will display our standard CAPTCHAs (without any ads) on your websites.

We appreciate your understanding and sorry for the inconvenience,
KeyCAPTCHA Team

Dear Visitors,

We are sure that our description "KeyCAPTCHA - Innovative Anti-Spam Service. We Pay For Your Protection" is clear and is not misleading. Everyone can find the detailed info on the same page. We are talking about the following info:

Variants of Using KeyCAPTCHA:
1. You earn money by using KeyCAPTCHA. In this case we pay you for ads in KeyCAPTCHA on your website.
2. You pay us for personal CAPTCHAs. In this case you can use your own images to create your own CAPTCHAs (containing your or third-party advertisement or without any ads) which will be displayed on your websites.

4. Free KeyCAPTCHA. In this case you don't earn money and you don't pay us. If you choose this way, we will display our standard CAPTCHAs (without any ads) on your websites.

That is why we closed this issue. We are open to discuss our decision but not with God Dog or Pregnant Coder or any other new nicknames of the same "person".
We hope that you understand why.

"The person spreading a slander and a lie regarding the KeyCAPTCHA Service uses different nicknames on different web resources"

Hello, Maxim Vladykin,
I am using different accounts on different web resources b/c they are deleted w/o any check by your requests while you routinely use multiple accounts and nicknames for postings in the same topic b/c you are professional spammer, scammer and blackhat specialist, the fact by which the owner of KeyCAPTCHA openly boasts on the internet.

For example, in http://forum.searchengines.ru the KeyCAPTCHA account and its clones (babnicks, Drew_007) were banned for aggressive spamming, off-topic and flame (personal insulting of its concurrent business in Russia) in the same single topic (btw, devoted to discusiion of another, KeyCAPTCHA's competitor, captcha and monetizing scheme!
If one example is not convincing, let me know for other examples.

I do not publish a single word that cannot be easily verified while you promote yourself and your KeyCAPTCHA service by dumping, slandering, spamming, insulting, compromising all around you (those who worked for you, your competitors, et al.)

Also read my answers in my: "Antispam “KeyCAPTCHA is Under Attack” Forum Spam as an Example of “Best PR is Black PR” Technique" and more facts in my blog.

I reopen this bug since nothing of what I mentioned was NOT even cosmetically addressed
