As seen in #658572: Add support for vertical tabs, the vertical tabs integration doesn't work fine if you don't have the og access active because this last module add the fieldset.
This patch change where the fieldset form is defined.

By the way, the og.module file has the EOL in Windows format.

    $form['og_nodeapi']['#collapsed'] = empty($groups);

Hrm.. I see in my current dev version all the fixes for vertical tabs are in place, but I am unable to get any of my OG fields into vertical tabs
