if using filter "Term ID (with depth) exposed" and if a node belong to more than one term,
then the result will have two or more!
could i avoid this ?

anyone figure this one out?
I have had to use a tweak in the template file but seems like views could manage this.
If any node is has two terms tied to it then you get duplicates.
For example
Parent - Color
Child -> Black
Child -> White

Node - Zebra
Set this to Black and White it will show up in a View (node type). I read earlier that you could use Term View Type BUT this does not give a way to show and sort and filter a bunch of nodes based on this Vocabulary.

Did you tryed out the use the "reduce duplicates" checkbox?

There are lots of ways to get duplicates and you aren't being very specific. If you just have an argument which specifies a single term ID, that will not generate duplicates. If you're using "Taxonomy: Term" as a field, yes, that can generate duplicates. You could use Taxonomy: All Terms instead.
