when selecting a photo using Gallery, the primary links menu appears on top of the dimmed area of thickbox

Sorry, a bit more information, this is happening in Acquia Marina theme, so not sure if its a thickbox issue or a theme issue?

This is due to the high z-index of the primary menu in this theme, just lower it or even remove in order to fix
