I'm unable to duplicate this issue. Can you provide more details? Steps to duplicate, other contributed modules you are using, what version of jquery (if using jquery_update).

I can confirm this issue. In my case I always get three (3) overlays. I am using jQuery 1.8.3 and too many contrib modules to list here. Sally's patch gets rid of the issue.
