Tabs as DIVs not Fieldsets - WCAG 2.0 usability issue

Is it possible to use horizontal tabs as divs not fieldsets? When you have fieldsets in form view everything is ok, problems starts when you are trying to use horizontal tabs in display view. WCAG 2.0 not allows use form tags (like fieldset) for grouping data on site.

The best idea would be to use DIV or even DETAILS tag from HTML5 but I can't force field_group to do it on display view.
