This is good for 6.x (does 6.x have the same bug with fataling?); 7.x doesn't actually need the hook_requirments as 5.2 is min for 7 https://drupal.org/requirements

tekante CreditAttribution: tekante commentedFixed via removal of hook_requirements from 7.x as the built in php version requirements check for Drupal 7 is sufficient. Added return to 6.x branch. Thanks for the report and patch.
