I went ahead and commented out using the custom magic file and only use the system default magic file for OpenSuse11.0 and worked.

The default magic says:
0 string \<?xml\ version="
>15 string >\0
>>23 search/400 \ !:mime image/svg+xml

yours say:
38 string \<\!DOCTYPE\040svg image/svg+xml

A simple svg by Inkscape for example has no DOCTYPE// correct or not inkscape is a pretty popular svg editor.
