FCK doesn't work if scripts are not in head

I couldn't get the FCK editor to load if the scripts fired from the end of my page template and not the beginning. I had moved the $scripts tag to the end so that scripts fired last, for a performance improvement, but FCK stopped working.

There is an easy fix, move $scripts back into the head, but I would still like to resolve the issue properly if possible.
