I've had a port for 5.x available that fixes most of the issues in the issues queue available for over half a year. I'm ready and willing to maintain this theme.

May also want to place a simiar issue in the webmasters query of drupal.org so that they can grant CVS access if/when necessary.

Considering the fact that this theme has been untouced for quite some time it is possible the developer has moved on. Have you tried contacting through this developers profile contact tab ?

Yes, I tried to contact the original developer through that avenue when I made the patches, and just sent him another note.
