I have followed the 'upgrade' instructions, but do not have the expected
$access_check=TRUE in the update.php file
What am I doing wrong?

This is only needed if you are not logged in as user 1. With this anyone can run update.php, so if you use it, remember to get rid of it afterwards.
Edit – if you set it to FALSE, that is. If it isn’t there, just add it.

Yep, if you're using D6, check the line $update_free_access = FALSE; and set to TRUE.
