This issue mirrors Default Moderation state of non draft state sets initial state as Draft, but is specific to the 7.x-1.x-dev branch.

This issue also appears to be related to Default Moderation state of Published creates Drafts instead.

The patch attached is similar to that of the first issue mentioned, but is more robust and does not contain any drupal_set_message() calls.
