Update - I did a quick change to this to force the seven theme design to be in the modal since the media.module is designed for it. Probably needs more checking around things and the tabs dont resize the popup (despite having additional content).

I am going to mark this as fixed since stuff is much better. Will cross our fingers that custom themes don't wreck too much havoc here.
