Checkbox for terms and conditions below/above the pane

I wonder if it is possible to put the checkbox below/above the pane so it stays visible even if the pane is collapsed ?
This way the user could check that he/she agrees to terms of service but doesn't have to see the terms of service all the time.
If someone would like to read them he would just expand them.
