3.x themes are not compatible with Drupal 4.0
Are you running Drupal 4.0 ?
You can see that downloads page separates modules and themes into two categories:
Modules for Drupal 4.x / Themes for Drupal 4.x
Modules for Drupal 3.x / Themes for Drupal 3.x
You can only use Drupal 4.x modules and themes in your Drupal 4.0 installation. Older, 3.x modules and themes are not compatible.
As a temporary solution you can just delete the node_index() function in your theme. I'd like to point you to documentation page "Upgrading Drupal 3.x themes to Drupal 4.x themes", but unfortunately it's still not yet written. Gotta have to add it to my TODO
