I just baught a theme that ..... needs 5.40 to run in an excellent way. The theme is not full compatible with 7.25. Can I still download  version 5.4?

Using any version of Drupal core below Drupal 7 at this point would present a security issue.

I know that was the reason I was so angry when the designer told me about it after purchase. After a lot of discussion they returned my money. But it is such a beautiful design that I'd like retry to install it.

I a know the security problem, So I don't know what to do....

The only thing you can do is work to upgrade the theme from D5 to D7. If you don't have the skillset to do so, you can hire someone to do it for you.
